MUMBAI: A 30-year-old Arabic teacher was found guilty of exposing obscene images to a youngster and masturbating by a special court in Mumbai established under the Protection of Children from Sexual Offenses (POCSO) Act. At the time of the incident (August 30, 2016), the child was 5 years old.
Her uncle had left her off at the nearby mosque around 5.30 p.m., where she was studying Arabic. At 7:00 p.m., the victim’s father took her home. When her mother inquired about what she had learned, the young lady stated that the accused had already shown her filthy photographs. He allegedly performed something and then wiped his private regions clean, according to her.
The mother told the father, and a case was filed at the Chembur police station the next day. The culprit was apprehended by the police, and his phone was taken. The suspects pled not guilty once the charge sheet was issued. The defence claimed that the victim’s family had failed to pay fees and that they wanted the victim to be promoted to the next class, implying that the accused was involved.
Bharti Kale, a special judge, stated that there isn’t a shred of evidence that the victim hasn’t paid her expenses. “I believe it exceedingly doubtful that the mother will jeopardise her daughter’s future for the sake of fees,” she continued.
“There is no justification from the offender of the pornographic photos found in his smartphone and how the victim became aware of the same,” the court continued.
The Arabic teacher was sentenced to one year of solitary confinement and a fine of Rs 10,000 by the court. In the event that the fine is not paid, he will be sentenced to three more months in prison. After the appeal process, an amount of Rs 8,000 was ordered to be paid to the victim as compensation from the fine.
