On the RTI questions of pornographic content in India: “MeitY is not custodian of such information”

NEW DELHI: A Right to Information (RTI) application was filed with Department of Electronics & Information Technology, Ministry of Electronics and Information Technology, Government of India. The RTI was filled to request information regarding pornographic content in India.

The RTI requested the following questions:

1. Is pornographic content completely banned in India?

2. Or only pornographic content that relates to child pornography is banned?

3. How the ban is being implemented?

In its response it was replied that “MeitY is not custodian of such information.”

It further said “However, transmission of pornography is a cyber crime as per IT Act 2000.”

The provisions of the Information Technology (IT) Act 2000, the Indian Penal Code (IPC) and the Protection of Children from Sexual Offences (POCSO) Act 2012 deals with pornographic content in India.
